Perfection of Litigation Documents


Good organization of court material is a key component of advocacy.    This is particularly so in the new era of electronic documents.  There have been a number of decisions in civil litigation and family matters in which Superior Court judges have emphasized the need for compliance with the notice to the profession requirements (now covered by the new consolidated directions), the Rules of Civil Procedure, and case conference endorsements regarding electronic material filed for hearings.   In short, their understandable concern is that material is often not sufficiently hyperlinked and bookmarked, nor has a compendium been filed, leaving them with the unenviable task of searching through hundreds, or even thousands, of pages to locate relevant documents. 


I have brought my decades of experience in matters before the Court of Appeal to prepare motion and application records, facta and compendia in the Ontario Superior Court of Justice, ensuring that judges have before them the most efficient and navigable documents possible.  Proper tables of contents, bookmarking, hyperlinking, text recognition, and removal of duplicate documents are essential.
